Question: Is a business name the same as a trademark?
Answer: No. A business name, as distinguished from a trademark, is used in connection with a legal or tax entity. A trademark, on the other hand is used in connection with a product or service.
Question: Is a federal registration valid outside the United States?
Answer:
No. However, if you are a qualified owner of a trademark application pending before the USPTO, or of a registration issued by the USPTO, you may seek registration in any of the countries that have joined the Madrid Protocol.
Question: Can a minor file a trademark application?
Answer:
This depends upon state law. If the person can validly enter into binding legal obligations in the state, then that person may sign a trademark application. Otherwise, a parent or legal guardian must sign the application, clearly setting forth their status as a parent or legal guardian of the applicant
